How to Protect Your Rights with a Stowers Demand Letter (And Why Most People Get It Wrong)
How to Protect Your Rights with a Stowers Demand Letter (And Why Most People Get It Wrong)
Let’s be honest. The insurance system was never built with small providers, community organizations, or everyday people in mind. It was built to delay, deny, and confuse—until you give up.
But that’s exactly why I teach people how to use Texas’s most powerful (and most ignored) tool against insurer bad faith: The Stowers Doctrine.
If you’ve ever had an injury claim stalled, lowballed, or outright sabotaged by an insurer, this blog is for you.
What Is a Stowers Demand Letter—and Why Does It Matter?
Under Texas law, if you are hurt because of someone else’s negligence—and you file a claim against their insurance—those insurers are required to settle your valid claim in good faith when they can. If they refuse to settle when they clearly should, they can later be held responsible for far more than just the policy limits.
This is called the Stowers Doctrine. And here’s the magic:
✔️ It forces the insurance company to pay a full, fair settlement, or risk being liable for the entire judgment if the case goes to court—even if the verdict blows past the policy limits.
✔️ If they ignore you, stall, or play games, they could get hit with a much bigger financial penalty later.
✔️ But only if you send a proper, legally valid Stowers Demand Letter.
A sloppy demand letter—or no letter at all—means you lose this protection.
How Insurers Trap You (Unless You Know This)
Most people (and even many lawyers) don’t fully understand how to make a Stowers Demand stick.
They send demand letters that are too vague.
They forget to include proof of liability.
They don’t offer a “full release.”
They don’t give the insurer a reasonable deadline to respond.
And guess what? The insurer thanks you—because they just dodged responsibility.
If your letter isn’t bulletproof, the insurer can walk away clean, even if they treat you unfairly. That’s why I hammer this over and over in client sessions:
A legally valid Stowers Demand is your shield against bad faith. Without it, you’re wide open.
What You Must Include in Your Stowers Demand Letter
✔️ Clear proof that the other party is liable (police reports, photos, repair estimates)
✔️ A specific settlement amount within the policy limits
✔️ An offer to fully release the insured (so the insurer can close the file)
✔️ A clear deadline (usually 10–14 days) for the insurer to respond
✔️ Delivery proof (like Certified Mail or a signature-confirmed email)
✔️ All supporting documentation—not just a letter, but real evidence backing your claim
Miss any of these, and the insurer’s lawyers will use the gap to avoid paying.
My Story: Learning the Hard Way So You Don’t Have To
In 2018, I survived a serious vehicle crash caused by a mechanical failure—a rear wheel separation. I did everything “right” at first: filed the claim, provided documents, and cooperated fully.
And the system still tried to crush me.
Adjusters changed mysteriously. Medical referrals disappeared. I was discharged from the hospital with no equipment, no plan, and no support. The insurer filed an interpleader to block my bad faith claims. Even my own attorneys started to abandon ship.
By 2025, five years later, I discovered the Stowers Doctrine myself and filed my own demand properly. When I did, the house of cards the insurer had built started to shake.
I want you to learn from my hard-earned experience, without wasting years and risking everything.
